United States Supreme Court Rules That, Under Existing Federal Law, Employers May Not Discriminate Based on Sexual Orientation or Gender Identity

On Monday, June 15, the United States Supreme Court ruled that Title VII of the Civil Rights Act of 1964, which, among other things, prohibits discrimination on the basis of “sex”, forbids employers from discriminating based on sexual orientation and gender identity. Minnesota employers were already prohibited from discriminating based on sexual orientation and gender identity by state law. Wisconsin employers were also prohibited from discriminating based on sexual orientation under state law, and Wisconsin government employers were forbidden from discriminating based on gender identity under an executive order by Governor Evers.
